1. Seller identification

In accordance with Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI), the owner of this online shop is:

Vegetal BioPlant S.L. researches, designs, manufactures, packages, distributes and sells fertilisers and products related to plant growing.

2. Purpose and acceptance

These General Terms and Conditions (the “Terms”) govern the sale of products through our online shop between Vegetal BioPlant S.L. and the person placing the order (the “Customer”).

By placing an order, the Customer declares that:

• They are of legal age and have legal capacity to enter into contracts.
• They have read, understood and accepted these Terms, which are expressly accepted by ticking the corresponding box during checkout.

We may amend these Terms at any time. Each order is governed by the Terms in force on the date it was placed. The Customer may print or save this document, and we can email it on request.

3. Information, prices and taxes

Prices. All prices are shown in euros (€) and include the applicable VAT. They do not include shipping costs, which are shown before completing the purchase, unless expressly stated otherwise.

Pricing errors. If, due to an obvious error, a product is published at an incorrect price, we will contact the Customer before shipping to decide whether to keep the order at the correct price or cancel it, in which case any amount paid will be refunded.

Taxes outside the EU. Shipments to the Canary Islands, Ceuta and Melilla are exempt from Spanish VAT (art. 21 of Law 37/1992), without prejudice to local taxes and duties. For shipments outside the European Union, import duties and taxes may apply and are payable by the recipient.

Availability. If a product is unavailable after the order has been placed, we will contact the Customer to offer a similar alternative or to wait for restocking. If neither option is accepted, we will cancel that part of the order and refund its amount.

Language. The contract is concluded in Spanish. If the Customer prefers, we can communicate in English, French, German or Italian.

4. Ordering process

In accordance with article 27 of the LSSI, the ordering process follows these steps:

1. The Customer adds products to the cart, where they can review items, quantities, prices and the total amount, and remove or change anything they wish.
2. By clicking “Checkout”, the Customer logs in, registers free of charge or buys as a guest, providing only the data needed for delivery.
3. The Customer chooses the delivery address, shipping method and payment method, and accepts these Terms and the Privacy Policy.
4. Once the order is confirmed, the Customer receives an email summarising the products, price, shipping costs, payment method and delivery details.

If the Customer notices an error in the order details, they should report it as soon as possible to info@madamegrow.es so it can be corrected. Please also check your spam folder so you do not miss our emails.

Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection, as detailed in our Privacy Policy.

We may cancel a transaction if we detect signs of fraud or payment irregularities.

5. Payment methods

The available payment methods are shown during checkout and on our payment methods page. Card payments are processed through a secure payment gateway; Vegetal BioPlant S.L. does not store card details.

Bank transfer. Bank details are shown at the end of checkout and in the confirmation email. To speed up shipping, the Customer may send the transfer receipt to info@madamegrow.es quoting their order number. The order is prepared once payment has been received.

An invoice in the Customer’s name is issued for each order and sent by email.

6. Shipping and delivery

Times and rates. Destinations, costs and delivery times are set out in our shipping policy and, for destinations outside the EU, in our shipping policy outside the EU.

Processing. We accept orders 24 hours a day, every day of the year. Orders received on working days before 14:00 (Spanish time) are prepared the same day; later orders, on the next working day. Weekend orders are prepared on Monday or the next working day.

Confirmation and tracking. When we hand the order to the carrier, we send a confirmation email with the tracking number.

Delivery address. Delivery is made to the address provided by the Customer, who is responsible for its accuracy and completeness.

7. Promotions and gifts

The conditions of our purchase-value gifts are set out in our promotion policy. Limited-time promotions apply to orders placed within the promotion period.

Unless stated otherwise, discount coupons cannot be combined with each other or with other promotions. We may cancel an order in which several coupons have been improperly combined, informing the Customer and refunding any amount paid.

8. Right of withdrawal

How to exercise it. Simply send us a clear statement before the deadline, by email to info@madamegrow.es or by post to our registered address, quoting your order number. You may use the form in the annex, although it is not mandatory. We will acknowledge receipt and give you the return address.

Returning the product. The Customer must return the product within 14 calendar days of notifying us of the withdrawal. Return costs are borne by the Customer, unless the product is defective or does not match the order. The Customer is liable for any diminished value of the product resulting from handling beyond what is necessary to establish its nature and characteristics.

Exceptions. Pursuant to article 103 of the same law, the right of withdrawal does not apply to:

• Sealed goods which are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery. By their nature, this includes fertilisers, substrates and seeds whose packaging or seal has been opened.
• Goods made to the Customer’s specifications or clearly personalised.

9. Refunds

In the event of withdrawal, we will refund all payments received, including the initial shipping costs (except any additional cost of choosing a delivery method more expensive than standard), within a maximum of 14 calendar days from the date you inform us of your decision. We may withhold the refund until we have received the product or until the Customer has supplied proof of having sent it back, whichever is earlier.

The refund is made using the same payment method used for the purchase, unless the Customer expressly agrees otherwise, at no cost to them.

10. Legal guarantee

All products are original and are covered by the three-year legal guarantee of conformity from delivery, in accordance with the Spanish consolidated General Law for the Protection of Consumers and Users.

If a product is not in conformity with the contract (for example, it arrives defective, does not match its description or is not fit for its normal use), the Customer may request its replacement and, where appropriate, a price reduction or termination of the contract, at no cost. To do so, write to info@madamegrow.es with your order number and a description of the problem (with photos if possible). We recommend letting us know as soon as possible so we can resolve it quickly.

The guarantee does not cover damage caused by improper use of the product or use contrary to its instructions for use, dosage and storage.

11. Liability

The instructions for use and dosage of our products are for guidance only. Results depend on factors beyond our control, such as the type of crop, substrate, water, climate or handling. Vegetal BioPlant S.L. is not liable for damage resulting from improper use of the products or use contrary to their instructions.

Nor is it liable for interruptions or errors in accessing the website that are not attributable to it. Nothing in these Terms limits the rights granted to consumers by consumer protection law.

12. Customer service and complaints

Our customer service is free of charge by email at info@madamegrow.es. You can also write to us through the contact form or chat with our virtual assistant on the website. If you prefer to call us on (+34) 657 220 534, the call will be charged at your operator’s rate.

Official complaint forms are available to consumers and can be requested by email or through the contact form. Your comments and suggestions are always welcome.

13. Partial invalidity

If any clause of these Terms is declared wholly or partly null or unenforceable, this will only affect that clause or the affected part, and the rest of the Terms will remain valid.

14. Governing law and jurisdiction

These Terms are governed by Spanish law. Where the Customer is a consumer, any dispute will be submitted to the courts of the Customer’s domicile, without prejudice to the mandatory rules applicable in their country of residence within the European Union. Where the Customer is a business or professional, both parties submit to the courts of Seville (Spain).
